　　美丽的地球已经存在了40多亿年，养育了人类20万年，而今天她在遭受毒害和污染，生物多样性被盗窃和掠夺，其速度之快，已经将我们自己的生存置于危险之中。

　　

　　在短短的100年里，在两次世界大战中生产致死千百万人的化学品的化工企业集团，用它们的化学品和技术继续屠杀，它们用有毒的农药扫荡了数百万个生物物种，破坏了我们赖以生存的生态系统，毒化了整个生命体系，它们正尽其所能掌控人类生活的所有领域以谋取利润。

　　

　　大公司如孟山都，拜耳，陶氏化学、杜邦、先正达公司，每一个都植根于战争、自由贸易、去管制的新自由主义商业，今天它们借助并购，尽力扩大自己的帝国版图。最新的事例是拜尔公司借助欧洲央行的资金以620亿欧元

　　

　　收购孟山都公司。其真实的含义是用公共资金来强化毁灭生命和人民权利的垄断集团。这些今日头戴光环的大公司，虽然在战后因反人类罪受过审判，却居然继续使用着同样的杀生之毒，还把自己伪装成人类的拯救者。

　　

　　短短20年中，这些战争罪犯们编造了摧毁地球的“自由”的贸易协议，把真正的食品生产者小农赶出了土地。它们扩大了控制种子的权力，剥夺了我们对食物的自由权力、我们的人权和民主权。它们垄断性的专利权和知识产权(IPRs)威胁的不仅是农民的种子权利，还有人民看得起病吃得起药物的权利，以及人民享受有营养的健康食物的权利。

　　百年生态屠杀和基因屠杀

　　

　　孟山都和拜耳公司是一丘之貉。它们分享技术的历史源远流长：在两次世界大战中它们用共享技术制造炸药和毒气，向作战的双方同时出售产品。拜耳公司曾是(德国)法本公司的一支，法本是希特勒的财源和化学工业的核心、又是战争物资供应商，它出售的氰化物类农药zyklon-b曾被用于犹太人集中营的大屠杀，纽伦堡审判时以此为证，判决法本公司及其合作伙伴犯有战争罪，其中有拜耳、巴斯夫、Hoechst(赛诺菲-安万特)。

　　孟山都和拜耳的合资公司Mobay在越南战争中负责生产橙剂的原料。在越南南方喷洒的MOBAY落叶剂和除草剂多达2000万加仑。时至今日还有畸形儿出生，成年人还在忍受慢性疾病和癌症的煎熬。

　　孟山都对地球的战争今天正在继续，它用的武器是耐受农达除草剂的转基因和草甘膦，已知这些东西能致癌;它的Bt转基因棉花将成百万农民推入债务火坑，迫使很多人自杀。

　　

　　世界各地的人民正在行动起来，讲求民主的政府正在对此生态屠杀和基因屠杀做出回应。而化学巨头们的回应，是攻击那些国家的法律和政府政策，而正是那些国家的政府采取了行动、回应了人民的呼声，采取了保护地球和人民权利的行动。许多现实的例证之一是：拜耳起诉印度政府，目的是维持它的具有危害性的药物Nexavar的垄断权。

　　奴役生命：给种子套上专利

　　

　　以往的20年，因为世贸组织规定了TRIPs协议(与贸易相关的知识产权协议，其中规定WTO成员国必须接受种子专利--译者注)，大公司集团已经用尽一切方法来占有我们的生命、种子和知识，它们的工具是专利，它们背后是贪婪的无法制约的权力。早在1995，

　　

　　孟山都公司的代表就承认过，它在起草世贸组织的TRIPs协定时，曾一身兼三职：即是病人，又是诊断者和医生。

　　

　　种子专利的门是这样打开的：先用基因工程改变种子，再宣称这是企业的发明所以归企业所有，垄断就是这样形成的。大公司向农民收取专利费，否认他们享有保存种子的权利，然后进一步剥夺农民和公民对种子和粮食的主权。

　　

　　与转基因相关的问题有遗传修饰、合成生物学和基因编辑，然而比安全更重要的、第一位的问题，是私人大公司企图拥有对地球生命的所有权。

　　

　　种子和生命的专利权违反了人类文化和道德。在侵犯生命的完整性的同时时，它还侵犯了农民的权力。

　　

　　一派胡言

　　

　　食品工业化、农业和社会生活的工业化，建立在一个虚假的前提之上：需要喂饱全世界，现实是：一个被战时工业体系塑造出来的农业，自身就是全球饥饿和营养不良的根源。声称产业化农业产量高、农药喷得少，同样是错误的，事实正相反。().

　　

　　20年的经验已经证明，转基因技术失败的。说的是控制杂草和害虫，结果它创造了超级杂草和超级害虫。

　　

　　但是专利权、使用费和企业的贪婪，使得转基因生物还在大力推广中。

　　

　　就像“竞争”只是自由贸易协议的遮羞布、垄断才是真正的结果，大公司的转基因计划正在摧毁生物多样性、多元化和民主，而这正是保护我们的食物、健康和生活的那个系统。举例，印度被迫以允许以竞争的名义允许孟山都进进入。而今天，印度95%的种子被

　　

　　孟山都掌握，农民深陷债务许多人自杀。同样，全球的医药巨头，和农药和生物技术巨头毫无二致，正在致力于摧毁不受专利束缚的制药业，让大家看不起病吃不起药。

　　

　　通过大公司并购产生交叉许可协议，更方便决策人玩弄概念引领方向，大公司可推卸责任，通过此种并非真正来自发明的种子专利，谋求更大的垄断权。

　　

　　这几家靠战争起家的大公司惯用“科学”二字攻击独立的科学和独立科学家，竭力维护和扩大它们的帝国。公司的宣传稿就是他们嘴里的科学，独立的政府和独立科学家手中的生物安全科学，竟然被它们指责为“反科学”。

　　

　　对知识、科学和民主实施攻击

　　

　　它们对独立的科学家和记者实施不间断的攻击，只是为了维持谎言：所谓转基因产品是创造奇迹养活世界的灵丹妙药，转基因生物应该得到发明专利、垄断市场。为此孟山都媒体、孟山都公关都出现了，孟山都炫耀自己就是科学，政府被大公司集团绑架了，孟山都可以对所有的科学证据嗤之以鼻、一心推进转基因生物。按照国际义务制定法律排斥种子专利生命专利的政府，保护生物多样性防止生物盗窃、维护本国公民的政府，现在正面临着国际上的和美国政府羽翼下的孟山都的重拳进攻。

　　

　　孟山都公司对转基因抗虫棉和其它种子的非法垄断，导致它控制了95%的

　　

　　棉花种子，提高了种子价格，农民被推入债务陷阱，已经有近30万

　　

　　农民自杀。由马哈拉施特拉邦政府指定的一个专责小组指出，转基因棉花推广的中心，就是农民自杀率最高的地方，Bt棉推广到哪里，哪里的农民就活不下去，转基因

　　

　　bt棉花因此得名“杀手作物”。

　　转基因农作物必然会通过授粉、风力传播而污染非转基因的作物，同时也送去了所谓的种子专利。孟山都公司竟然把环境案例中“污染者付费”的通行原则倒转过来，起诉被污染者并强迫他们赔偿。这是加拿大的佩尔西.施迈泽和澳大利亚的史蒂夫.马什的亲历事件;遭到孟山都起诉的还有数百名农场主。

　　

　　抗虫和抗除草剂的转基因技术的失败，已经无可否认，转基因巨头因此争相推进基因转化、合成生物学和基因编辑法。这是为了规避对转基因食品的监管法规，而这正是全世界人民的强烈要求。佛蒙特州因实行转基因标注法而被孟山都公司起诉。孟山都公司千方百计推行的一项保护自己否决美国人知情权的法案(被称为黑暗法)仅仅在不久前被参议院否决。

　　

　　流氓公司无法无天

　　

　　如果转基因食品真的像大公司宣传的那样安全，它们一定会到处炫耀。既然它们不炫耀必有隐情。它们花费无数金钱去掩盖负面消息，特别是2015年世界卫生组织证明的草甘膦除草剂农达/草甘膦是一种致癌物质这个信息。().

　　

　　当孟山都宣称掌握了神奇的技术、拥有了对种子和生命的所有权时，它大谈实质等同，意图绕过安全管理和环境与健康评估。这是十足的精神分裂症。同一个生物体，既是新发明又是自然物，那怎么可能

　　

　　化学巨头公司引入种子和生命专利之后20年，它们把自己都做成了基因和种子巨头。以种子和生命的非法专利为武装，这些跨国企业开始收购小公司，关闭公共育种机构，摧毁种子主权和人民对于食物的自由权。对种子的控制权集中到极少数大型公司手中。“

　　

　　六巨头”是巴斯夫、拜耳、杜邦、陶氏化学、孟山都和先正达。孟山都曾试图购买先正达，而先正达现在正被中化并购。被陶氏化学收购的联合碳化物公司，过去制造了博帕尔灾难，现在仍然在杀戮和残害数以百万计的生灵，而陶氏化学自己已与杜邦合并。拜尔公司不甘示弱，试图收购孟山都。并购之后的交叉许可协议，使得让谁进入飞机驾驶舱，变成一个概念问题;看谁能推卸掉责任，谁会用不能被发明的种子获得专利、扩大垄断权。

　　

　　以化学毒物为基础的农业所排放的温室气体占总量50%之多，因此大公司盗窃农民千百年培育出来的、能应对气候变化的农作物种子，是生物海盗行为，被盗者已被做成1500多项专利。

　　

　　霍皮人所说的“变形金刚”(powaggatsi)，就是今天我们面对的破坏性力量，它在所到之摧毁生命的活力。如果让大公司为所欲为，我们的脆弱生命之网将被它们毒化，多样性的物种将被驱赶至灭绝之境，人民将失去对一切种子的自由权、失去食物、失去知识和决定权。

　　

　　生命、人类社会和民主，全都面临严重的威胁。我们绝不能允许世界走向这个方向。

　　

　　我们热爱地球，我们一定要保护她的生物多样性，我们一定要捍卫她和公民的权利。

　　

　　为了这一切，10月14-16日我们将在海牙组织人民的集会，开庭审判孟山都。

　　THE CORPORATE WAR AGAINST THE PLANET, PEOPLE ANDDEMOCRACY

　　

　　This beautiful planet that has evolved over 4-5 billionyears and sustained humanity for 200,000 years is now poisoned andpolluted and its biodiversity is being pirated and plundered atrates that threaten the very existence of ourspecies.

　　

　　In just 100 years, the chemicals and technologies ofwar-based conglomerates, which produced and profited from thechemicals that killed millions of people during the two world wars,continue to kill, wiping out millions of species by spreadingpoisonous agrichemicals, destroying ourecosystem, poisoning the entire web of life and are taking overevery aspect that they can of our lives for financialprofit.

　　

　　Corporations like Monsanto, Bayer, Dow, Dupont, Syngenta,all have their roots in warfare and through free trade neoliberalpolices and deregulation of commerce, they enlarge their empirewith mega buyouts. Such is thecase with the most recent bid by Bayer to buy Monsanto for 62billion euros facilitated by the European CentralBank. This in effect means public money being used tostrengthen the monopoly of destroyers of life andpeople’srights.These hallowed corporationsof today, that have been tried and tested for crimes againsthumanity in the post war years, continue to use the same poisonsthat kill, but under the guise of being saviors ofhumanity.

　　

　　In just 2 decades these war criminals have fabricated‘free’tradeagreements that are destroying the earth and pushing small farmers,the real producers of food, off the land. Theyhave enlarged their control over our seed, robbing us of our foodfreedom, our human rights and our democracy.Through patents and intellectual property rights(IPRs), they have established monopolies, threateningfarmers’rights to seed,people’s rights to affordable medicineand people’s rights to healthy,nutritious food.

　　The Hopi describe this phenomena asPowaqqatsi– “an entity,a way of life, that consumes the life forces of beings in order tofurther its ownlife”.

　　

　　A century of Ecocide and Genocide

　　

　　Monsanto and Bayer have a long commonhistory. They made explosives and lethal poisonous gases usingshared technologies and sold them to both sides of the two WorldWars. Bayer was part of I.G. Farben,Hitler’s financial core andstalwartchemical conglomerate andsupplier of, among other poisons, Zyklon-B, acyanide based pesticide used in concentration camps during theholocaust which was usedas evidencein the Nuremberg trials, finding I.G. Farben and its partners,which included Bayer, BASF and Hoechst (Aventis) guilty of warcrimes.

　　Monsanto and Bayer had a JointVenture–MOBAY–whichsupplied ingredients for Agent Orange in the Vietnam War.20 million gallons of MOBAYdefoliants and herbicides were sprayed over South Vietnam.As a result still today children are born withbirth defects, adults have chronic illnesses and are dying ofcancers.().Monsanto’swar against the planet and people continues today with the Round upReady GMO/Glyphosate which has shown to be carcinogenic, as well asits BT cotton which has pushed millions of farmers into debt andsuicide.().

　　

　　Across the world people are rising, democraticgovernments are responding to stop this ecocide and genocide.These giants have responded by attacking laws andpolicies of governments that take action in response topeople’s movements and call to protectthe earth and people’s rights.One of the now many examples is that of Bayersuing the Indian Government to retain itsmonopoly rights on its hazardous drugNexavar.()

　　

　　OwningLife–Patentson Seed

　　

　　Over the last 2 decades since the TRIPS Agreement of theWTO, corporations have made every attempt to ownlife, our seeds, and ourknowledge through intellectual property rights, using theinstrument of patents on seed and life, propelled by greed andlimitless power.In 1995, aMonsanto representative admitted that in the writing of the TRIPSagreement of the WTO they werethe patient, diagnostician and physician all in one.

　　

　　Through genetic engineering and by declaring that seed canbe a corporate invention, and therefore can be owned bycorporations, the door to patents was opened, allowing them tocreate monopolies, collect royalties from farmers,deny them their right to share and save seed, androb them and citizens of their rights to seed and foodsovereignty.

　　

　　In addition to safety issues, including geneticmodification, synthetic biology and gene editing linked to GMOs,the overriding issue is the owning of life onearth.

　　

　　Patents on seed and life are unethical and immoral, theyviolate the integrity of life and violate therights of farmers.

　　

　　False claims and narratives

　　

　　The entire industrialization of food, agriculture and lifeis based on the false claim of feeding the world, when the realityis that an agriculture that has been shaped by the war industry isat the root of the hunger and malnutrition in the world.Equallyerroneousare the claimsthat industrialized agriculture produces higher yields and reducesthe use of pesticides when reality has shown that the opposite istrue.

　　

　　The last two decades of experience with GMOs has shownthat it is a failed technology - instead of controlling weeds andpests it has created super weeds and superpests.(

　　

　　).Despitethis, patents, royalty collections and corporate greed continue topropel the spread of GMOs.

　　

　　While competition is the rhetoricoffree tradeagreements,monopolyisthe outcome and as such they are destroying diversity, pluralismand democracy, the systems that protect our food, health andlivelihoods. For example, India was forced toallow the entry of Monsanto in the name of competition. TodayMonsanto controls 95% of the seed supply and has established atotal monopoly pushing farmers into debt and suicide.Similarly, the global pharmaceutical giants,which are no different to the agrichemical and biotech giants, areattempting to destroy the generic drugs industry and affordablemedicine.

　　

　　Through cross licensing agreements like these mergers andacquisitions, which of these will be in the cockpit will be decidedby issues of image, and shedding liability and expanding monopolyrights through patents on non-inventions such as seed.

　　

　　While using theterm‘science’,these war-based corporations attack independent science andindependent scientists to maintain and expand their empires.Corporate propaganda is their so-called science,and the science of biosafety by independent governments andscientists isbranded“anti–science”

　　

　　Attack on knowledge, science anddemocracy

　　

　　Independent scientists and journalists have beensystematically attacked to maintain thelie

　　

　　that GMOs are the miracle panacea to feed the world andGMOs as an invention that justifies patent monopolies.As a consequence we have a Monsanto media,Monsanto public relations parading as science andgovernments that have been hijacked by the corporations,discounting all scientific evidence to continueimposing GMOs. Governments thatmade laws in accordance with international obligations to excludepatents on seed and patents on life and to protect biodiversity andprevent its biopiracy to protect their citizens,are now facing major attacksfrom the Monsantos of the world and the US government.

　　

　　Monsanto’s illegitimatemonopolies on BT cotton seeds and illegitimate control of seed hasled to their control of 95% of the cotton, toincreased seed prices, trapped farmers in debt and to some 300,000farmers committing suicide. Atask force appointed by the government of Maharashtra, theepicenter of BT cotton as well as farmer suicides, has shown thatwherever there is BT there are suicides and have termedthem“killercrops”.

　　

　　GMOs will inevitably contaminate non GM crops throughpollination and wind and with patents on genes and seeds, Monsantohas reversed the environment principleof‘polluterpays’, by suing andensuring that it is the polluted who pay. This iswhat happened with Percy Schmeiser in Canada and Steve Marsh inAustralia. They have also sued hundreds of otherfarmers.(

　　

　　With the widespread recognition of the failure of BT andHT technologies, the gene giants are rushing to push new tools ofgenetic transformation and genetic engineering such assynthetic biology and gene editing. They aredoing this to bypass the biosafety regulation of GMOs that peopleacross the world are demanding. Vermont has beensued by Monsanto to prevent its GMO labeling law.Monsanto’sattempt to introduce the DARK Act (DenyingAmericans the right to know) was only just recently rejected by theSenate.

　　

　　Rogue corporations spreading lawlessness

　　

　　If GMOs are as safe and as good as the corporations claim,they would declare their products loudly and clearly.Their refusal to do so is an implicit knowledgeof their harmful effects, which is why they spend millions ofdollars to counter negative findings such as the report of WHO in2015 attesting that Roundup/ glyphosate is acarcinogen.().

　　

　　While Monsanto claims novelty to own seed and life itdeclares sameness and substantial equivalence to bypass biosafetyregulation which assesses harm to the environment and publichealth. This is ontological schizophrenia. The same organism cannotbe a new invention and natural at the sametime.

　　

　　In the 20 years that patents on seed and life have beenintroduced by the chemical giants, they have today become the geneand seed giants. Armed with illegitimate patentson seed and life these multinationals began buying up smallercompanies, shut down public breeding and destroying seedsovereignty and people’s food freedom.Concentration of control overseed is narrowing into a handful of mega-corporations.The "Big 6" pesticide and GMOcorporations which own the world’s seed,pesticide and biotechnology industriesareBASF,Bayer,Dupont,DowChemicalCompany,Monsanto,andSyngenta.Monsantoattempted to buy Syngenta which is now merging withChemChina.DowChemical which bought up Union Carbide which was responsible forthe Bhopal disaster and which still today is killing and maimingmillions, is now merging with Dupont.Not to be outdone,Bayer is now buying up Monsanto.Throughcross licensing agreements like these mergers and acquisitions, whowill be in the cockpit will be decided by issues of image, sheddingliability and expanding monopoly rights through patents on noninventions such as seed.

　　

　　Having contributed as much as 50% of greenhouse gases andclimate change through a chemical and poison based agriculture,corporations are now stealing climate resistant traits that farmershave evolved over years to combat climate change.This is biopiracy of climateresilience, and more than 1500 patents havealready been biopirated.

　　

　　The Powaggatsi phenomena of the Hopi is clearly inevidence today - we are dealing with a destructive force that istaking out life forces wherever itcan:Ifthe corporations have their way our fragile web of life will bepoisoned and broken, the diversity of species will be driven toextinction, people will lose all freedoms to their seed, to theirfood, to their knowledge anddecisions.

　　

　　Life, society and democracy are under threat.We refuse to allow this futureto unfold.

　　

　　We love the earth, we will protect her diversity, and wewill defend her andcitizens’rights.

　　

　　That is why we are organising a Monsanto tribunal andPeople’s assembly in the Hague from 14thto 16th October .
